Comprehensive Personal Injury Representation For Car Accidents In Louisville

At Conliffe, Sandmann & Sullivan, PLLC, our car accident lawyers know it takes just one second of distracted driving to cause a car wreck resulting in a lifetime of pain. Louisville’s bustling roads see a variety of vehicles, from personal cars to commercial trucks and vans. As a central hub for UPS and numerous other commercial entities, accidents involving these vehicles are not uncommon.

Our team represents clients in all types of vehicular accidents, whether it involves a personal vehicle, an 18-wheeler or a commercial Sprinter van. We recognize the unique challenges each case presents and are here to address your specific needs.

We will take the time to listen to your story so that we can understand the details of your accident. We then develop a strategy that prioritizes your well-being.

What Steps Should I Take If I Am Injured In A Car Accident?

Get medical help as soon as possible. Even if your injuries appear minor, be sure to see a health care provider to document your injuries. After calling 911 and filing a police report, take the following steps:

  • Record the scene: If you are able, take pictures of the accident site, including damages to the vehicle, highway conditions and your injuries
  • Collect information: Get contact and insurance details from the driver(s). Get what information you can from eyewitnesses.
  • Retrieve the accident report: The police report of your accident will be necessary for insurance claims and any legal proceedings.
  • Talk to your insurance company: Tell your insurance provider about your accident.

How Quickly Should I Reach Out To A Car Accident Attorney?

Because of Kentucky’s complex car accident laws, we recommended speaking with a lawyer as soon as possible after the accident. Our car accident lawyers can help clarify your rights, guide you through legal processes and negotiate with insurance companies. Early consultation is especially useful if there are disagreements over fault or if you have significant injuries.

What Is The No-Fault System In Kentucky?

Kentucky follows a no-fault car insurance system. This means that drivers will need a file claim with their own insurance after an accident. Drivers are required to have Personal Injury Protection (PIP) insurance which typically covers a certain amount of your medical costs and work wages, regardless of who was at fault in your accident.

You may be able to file a personal injury claim against the other driver if:

  1. Your PIP coverage is used up
  2. Medical costs exceed $1,000
  3. You have serious injuries like permanent disfigurement or broken bones

Due to high medical costs, many accidents meet the criteria for filing a claim against the other driver once PIP is exhausted. The minimum insurance coverage required includes:

  • $25,000 for bodily injury per person and $50,000 per accident.
  • $25,000 for property damage per accident.
  • $10,000 PIP coverage per person.

Liability insurance is used if the other driver exhausts their insurance and claims against yours.

Drivers can opt out of the no-fault system by filing with the Kentucky Department of Insurance. They still need liability insurance but not PIP. Opting out allows drivers to sue the at-fault driver immediately but may result in higher premiums and longer payout times.

What Compensation Might I Receive If I Am Injured In A Car Accident?

You might have a right to receive reimbursement for your ambulance and emergency room bills, prescriptions, ongoing doctor visits, rehabilitation expenses and other costs related to the accident. You may also be entitled to receive compensation for:

  • Lost income: If the injury prevents you from working, you might receive compensation for lost wages.
  • Pain and suffering: You may receive compensation for physical discomfort and emotional trauma resulting from the accident.
  • Car repairs and property damage: You should be reimbursed for damage to your vehicle and other personal belongings.
  • Wrongful death: Depending on the situation, you might be eligible for other damages, such as loss of companionship or punitive damages in cases of severe negligence.
